Q: Do I need a permit?
A: Zoning permits are required before erecting, constructing, or adding to the square footage of a structure on a parcel. This includes any building over 100 sq. ft., decks over 300 sq. ft., or structural additions. You must obtain a permit before starting any work, and all applications must be submitted directly to the zoning officer. Q: Do I need a permit for a swimming pool? What is required?
A: Yes, a zoning certificate is required for a swimming pool. They must be placed in either a side yard or rear yard. An above ground pool must have a ladder which can be removed or folded-up to prevent access. In-ground pools shall be surrounded by a security fence, at least four feet (4') in height, with access though a locked gate.
Q: Do I need a permit for solar panels?
A: If the solar panels are on the ground or on a new structure, changing the square footage and impervious surface area on a property, a permit is needed. If they are placed on an existing rooftop structure, no permit is necessary.
Q: Can I put a storage unit or semi-trailer storage unit on my property?

Q: Can I apply for a variance?
A: Any variance requests will go before the Zoning Hearing Board. The board shall hear requests for variances where it is alleged that the provisions of the Zoning Ordinance of McKean Township inflict unnecessary hardship upon the applicant. The board may grant a variance, provided that all the following findings are made where relevant in a given case:
(1) That there are unique physical circumstances or conditions, including irregularity, narrowness, or shallowness of lot size or shape, or exceptional topographical or other physical conditions peculiar to the particular property and that the unnecessary hardship is due to such conditions and not the circumstances or conditions generally created by the provisions of the Zoning Ordinance of McKean Township in the neighborhood or district in which the property is located.
(2) That because of such physical circumstances or conditions, there is no possibility that the property can be developed in strict conformity with the provisions of the Zoning Ordinance of McKean Township and that the authorization of a variance is therefore necessary to enable the reasonable use of the property.
(3) That such unnecessary hardship has not been created by the appellant.
(4) That the variance, if authorized, will not alter the essential character of the neighborhood or district in which the property is located, nor substantially or permanently impair the appropriate use or development of adjacaent property, nor been detrimental to the public welfare.
(5) That the variance, if authorized, will represent the minimum variance that will afford relief and will represent the least modification possible of the regulation in issue.
Q: Where do I get a building permit?
A: A building permit is different than a Zoning permit. McKean Township has opted out of the UCC (Uniform Construction Code), which means the township does not issue building permits. However, it is the responsibility of the residents to obtain any necessary inspections and permits for their structures by any certified inspection company of their choosing. It is a Pennsylvania State Law to have the inspections done and many insurance companies will require the inspection reports.
