Resolution No. 2-2024
A RESOLUTION REPLACING RESOLUTION 1-2023 DESIGNATING MCKEAN COMMUNITY PARK AND PLAYGROUND OF AS BEING TOBACCO-FREE AREAS IN CONJUNCTION WITH THE PA DEPARTMENT OF HEALTH’S YOUNG LUNGS AT PLAY PROGRAM
Whereas, the McKean Recreational Authority is dedicated to the health and well-being of its children, caregivers, pets, and visitors and believes that tobacco products used in proximity of children, youth, and adults engaging in or watching recreational activities are unhealthy and detrimental to the health of others; and
Whereas, tobacco products are defined as:
(a) Any product containing, made, or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including, but not limited to cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, snuff; and
(b) Any electronic device that delivers nicotine or other substances to the person inhaling from the device, including, but not limited to an electronic cigarette, modified vaping device, cigar, pipe, or hookah; and
(c) Notwithstanding any provision of subsections (a) and (b) to the contrary, “tobacco product” includes any component, part, or accessory of a tobacco product, whether or not sold separately. “Tobacco product” does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where such product is marketed and sold for such an approved purpose; and
Whereas, in Pennsylvania 858,000 youth are exposed to tobacco smoke pollution every day and the US Surgeon General has stated that there is no safe level of exposure to secondhand smoke, whether indoors or outdoors, and that children’s exposure to secondhand smoke causes increased risk of sudden infant death syndrome (SIDS), lower respiratory infections, middle ear diseases, more severe asthma, respiratory symptoms, and slowed lung growth and is responsible for the premature death of over 430,000 Americans each year from lung cancer, heart disease, respiratory illness, and other disease; and
Whereas, in Pennsylvania, non-smokers continue to be exposed to life-threatening secondhand smoke at thousands of public spaces across the commonwealth, such as bars, restaurants, and parks; and
Whereas, each year in Pennsylvania, about 18,000 youth under the age of 18 try cigarettes for the first time; and
Whereas, the American Lung Association reports nearly 8,000 youth will start vaping every day; and
Whereas, secondhand smoke is responsible for over 50,000 deaths among nonsmokers each year;
and
Whereas, to help role-model non-smoking behavior to children and youth; to provide children, youth, and their families with a safe, smoke-free environment:
Now, therefore, be it resolved by the Appointed Members of the McKean Recreational Authority as follows:
Section 1: McKean Community Park and Playground shall be designated as nicotine and tobacco-free zones and tobacco products shall be prohibited from the same.
Section 2: Young Lungs at Play Signs or other appropriate signage will be posted delineating the tobacco-free area provided by Regional Primary Contractor for Tobacco Prevention and Control
Section 3: Enforcement – The McKean Recreational Authority hereby authorizes its appointed officials to take whatever steps are necessary for full participation in and compliance with the Young Lungs at Play Program and/or other such programs of the Commonwealth of Pennsylvania
Section 4: The residents of McKean Township and McKean Borough shall be notified of this Resolution and designation of the tobacco and nicotine-free zones as stated herein;
Section 5: Cessation Resources – Tobacco cessation and awareness programs, referrals and resources will be made available to employees and visitors/vendors who desire to stop using tobacco. PA Free Quitline, 1-800-QUIT-NOW and PA.Quitlogix.org
Section 5: This resolution shall become effective upon recordation of the same in the Official Authority Resolution Book.
